Virtual Makgeolli Making Event

Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1.  Eligibility

The VIRTUAL MAKGEOLLI MAKING EVENT (the “Event”) is sponsored by aT Center LA (the “Event Sponsor”). The Event is being administered on behalf of the Event Sponsor by Urban Creator Inc. (the “Event Agency”). You must be over 21 years of age to participate. Void in Alabama, Hawaii (Honolulu, Kauai, and Hawaii), Indiana, Maine, Maryland, Michigan, Minnesota, Mississippi, New Jersey, North Carolina, North Dakota, Pennsylvania, South Dakota, Vermont, Washington, West Virginia, and Wyoming.  Void where restricted or prohibited.

Employees, their immediate family members, those living in the same household of employees of the Event Sponsor, the Event Agency, and their respective affiliates, subsidiaries and suppliers are not eligible to participate. The Event is subject to all applicable federal, state, and local laws and regulations.

2.  Agreement to Official Rules

By participating, you agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Event Sponsor as final and binding as it relates to the Event and interpretation of these Official Rules.

3.  Event Period

Entries will be accepted starting on October 10, 2020 at 12:00:01 a.m. Pacific time and acceptance of entries will terminate on October 17, 2020, at 11:59 p.m. (midnight) Pacific time (the “Event Period”).

4.  How to Enter

To be eligible for this Event, an individual or representative of an organization must submit the entry through the following method.

This event is in no way sponsored, endorsed, administered by or associated with Facebook or Instagram.

5. Requirements of Entries

An entry may not contain, as determined by the Event Sponsor, in its sole discretion, any content that:

• is sexually explicit or suggestive; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; or contains nudity;

• promotes irresponsible drinking, underage drinking, or the abuse of alcohol, use of illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;

• is obscene or offensive, or endorses any form of hate or hate group;

• appears to duplicate any other submitted entries;

• defames, misrepresents or contains disparaging remarks about other people or companies;

• contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors, or theme parks) owned by others, without their permission;

• contains any personally identifying information, such as personal names or e-mail addresses;

• contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without their permission;

• contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without their permission;

• contains look-alikes of celebrities or other public or private figures, living or dead;

• communicates messages or images inconsistent with the positive images and/or goodwill to which we wish to associate; and/or

• violates any law.

6. Prizes

All winners will be invited at the virtual party event on October 30, 2020 and received a Makgeolli brewing package and Korean ready to eat food packages (Approx. Retail Value: $120)

Any and all prize-related expenses, including without limitation, any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. The winner may be required to submit a W9 or other tax form prior to receiving the prize.

7.  Winner Selection and Notification

All winners will be selected randomly. Winners will be contacted through Instagram DM (Direct Message) and be asked for email address, shipping address, phone number and name.

All winners will be announced through an Instagram post on 10/18/2020.

The Event Sponsor shall have no liability for a winner’s failure to check the winner announcement post on the aTCenterLA Instagram page. The Event Sponsor shall have no liability for a winner’s failure to receive notices due to the winner’s spam, junk e-mail, or other security settings or the winner’s provision of incorrect or otherwise non-functioning contact information.

Winners must submit an affidavit of eligibility and compliance with these Official Rules. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within Three (3) days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited, and an alternate winner selected. The receipt by a winner of the prize offered in this Event is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE RULES BY ANY WINNER (AT EVENT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE EVENT AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.

8. Odds of Winning.

 The odds of winning depend on the total number of eligible entries received.

9. Rights Granted by You

By entering this Event you understand that Event Sponsor, anyone acting on behalf of Event Sponsor (including Event Agency), or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review, or consent to print, publish, broadcast, distribute, link to, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Event (including written, photographic and audiovisual recordings, descriptions, or postings of events where a prize is redeemed), and biographical information as news, publicity or information and for trade, advertisements, public relations and promotional purposes without any further compensation.

10. Terms

Event Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the event, if (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Event. In such cases, The Event Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by The Event Sponsor. Event Sponsor reserves the right at its sole discretion to disqualify any participant who tampers or attempts to tamper with the entry process or the operation of the Event or violates these Official Rules.

The Event Sponsor has the right, in its sole discretion, to maintain the integrity of the Event, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by these Official Rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Event may be a violation of criminal and civil laws and should such an attempt be made, Event Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

11. Limitation of Liability: By entering, you agree to release and hold harmless Event Sponsor, Event Agency and their respective  subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Event and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Event; or (v) electronic or human error which may occur in the administration of the promotion or the processing of entries.

Winner acknowledges that except and to the extent that the Event Sponsor and Event Agency cannot by law exempt itself from responsibility or liability, the Event Sponsor and Event Agency has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee described herein; including, but not limited to, quality, merchantability, mechanical condition or fitness for use. All warranties are hereby disclaimed, and the winner will accept the prize “as is”.

12. Disputes: THIS EVENT IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICAAND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW PRINCIPLES. As a condition of participating in this Event, the participant must agree that any or all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Event, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Los Angeles, California having jurisdiction. Further, in any such dispute, under no circumstances will the participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Event), and participant further waives all rights to have damages multiplied or increased.

13. Privacy Policy: Information submitted with an entry is subject to be used for marketing purpose of aT Center
